2. Scope of This Policy

This Privacy Policy applies to personal information we collect:

This Privacy Policy does not apply to:

3. Information We Collect

A. Information You Provide Directly

Name, email address, phone number, company name and job title, billing and payment details, account credentials, communications you send to us, information submitted through forms, demos, surveys, waitlists, or support requests, and content you provide to our AI systems (prompts, files, text, images, audio, video, datasets, and feedback).

B. Information Collected Automatically

IP address and approximate location, device identifiers, browser type/version/OS, referral URLs and clickstream data, usage logs and session data, cookies and similar tracking technologies.

C. Information From Third Parties

Analytics providers, advertising and marketing partners, authentication providers, payment processors, CRM and sales tools, public sources such as company websites or professional directories, and customers who invite or authorize you to use our Services.

D. Sensitive Information

Depending on how our Services are used, we may process information that could be considered sensitive under certain laws, such as precise geolocation, account credentials, government identifiers, financial information, or contents of communications. We ask users not to submit sensitive personal information unless necessary and authorized.

4. How We Use Information

Where required by law, we rely on recognized legal bases for processing, such as consent, contract performance, legal obligation, and legitimate interests.

5. AI-Specific Data Use

A. Inputs and Outputs. Our Services may allow users to submit prompts, documents, media, datasets, or other content (“Inputs”). Our systems may generate responses, predictions, analyses, recommendations, or other results (“Outputs”).

B. Model Improvement. We may use Inputs, Outputs, feedback, usage data, and related metadata to improve our Services, models, and safety systems, unless we expressly state otherwise in writing, you opt out where an opt-out mechanism is offered, we are contractually restricted from doing so under a separate agreement, or applicable law prohibits such use. We do not use Protected Health Information (PHI) for model training or product improvement. PHI is processed only where a Business Associate Agreement (BAA) is in place, and only as that BAA and HIPAA permit.

C. Human Review. Authorized personnel and service providers may review non-PHI content for support, quality assurance, safety, abuse prevention, legal compliance, and model improvement purposes. PHI is not subject to general human review; it is accessed only as permitted by a signed BAA and limited to the minimum necessary to provide the Services.

D. Accuracy and Automated Processing. AI-generated outputs may be inaccurate, incomplete, or unsuitable for certain decisions. You should not rely solely on AI outputs for legal, medical, employment, credit, housing, insurance, or similarly significant decisions without independent human review and verification.

E. Customer Data Processing. Where we process data on behalf of enterprise or API customers, we may act as a processor or service provider, and our processing will be governed by applicable contracts such as a Data Processing Addendum (DPA).

HIPAA & Protected Health Information (PHI)

The Services are not designed to collect or process Protected Health Information (PHI) as defined by HIPAA unless the Company and the client have executed a Business Associate Agreement (BAA). Absent a signed BAA, you should not submit PHI to the Services. Where a BAA is in place, the Company acts as a Business Associate: it uses and discloses PHI only as the BAA and HIPAA permit, applies required administrative, physical, and technical safeguards, limits access to the minimum necessary, flows down Business Associate obligations to relevant subprocessors, does not use PHI for model training or product improvement, and provides breach notification as required by the HITECH Act. This Section controls over any conflicting statement in this Policy with respect to PHI.

6. Cookies and Tracking Technologies

We and our partners may use cookies, pixels, SDKs, local storage, and similar technologies to operate the Services, measure traffic and engagement, support marketing and advertising efforts, and improve functionality and security.

You can control cookies through your browser settings. Some regions require consent for non-essential cookies, and we use consent mechanisms to support that where applicable. You may also opt out of interest-based advertising through industry opt-out tools.

7. How We Share Information

We do not sell personal information in exchange for monetary consideration. If any of our data practices qualify as “selling” or “sharing” under the California Consumer Privacy Act (CCPA/CPRA), we will provide the required disclosures and opt-out mechanisms on our website.

8. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services and fulfill the purposes described in this Policy, maintain business/financial/tax records, comply with legal and regulatory obligations, resolve disputes and enforce agreements, and support legitimate business needs such as security, fraud prevention, backup, and service improvement.

Retention periods may vary depending on the type of information, the purpose of processing, and applicable legal requirements. When personal information is no longer needed, we will securely delete or anonymize it.

9. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure. These safeguards may include access controls, encryption, logging, monitoring, vendor oversight, and regular security testing.

However, no method of electronic transmission or storage is completely secure. While we strive to protect your personal information, we cannot guarantee absolute security and shall not be held liable for any breach beyond our reasonable control.

10. International Data Transfers

We may process and store information in the United States and other countries where we or our service providers operate. These countries may have data protection laws that differ from those in your jurisdiction.

Where required by applicable law, we use appropriate safeguards for international transfers, such as Standard Contractual Clauses (SCCs), contractual protections, or other lawful transfer mechanisms recognized under applicable data protection frameworks.

11. Your Privacy Rights

A. General Rights. You may have the right to access personal information we hold about you, request correction of inaccurate or incomplete information, request deletion of your personal information, object to or restrict certain processing activities, withdraw consent where processing is based on consent, request portability of your personal information, and opt out of certain marketing communications.

B. California Residents. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know, delete, correct, opt out of sale/sharing, limit sensitive personal information use, and not be discriminated against for exercising your privacy rights.

C. EEA/UK Residents. If you are located in the European Economic Area (EEA), United Kingdom, or similar jurisdictions, you may have rights to request access, rectification, erasure, restriction, object to processing, request portability, and lodge a complaint with a supervisory authority.

13. Marketing Communications

Even if you opt out of marketing messages, we may still send service-related or transactional communications necessary for the operation of your account and the Services.

14. Children's Privacy

Our Services are not directed to children under the age of 18, and we do not knowingly collect personal information from children without appropriate parental or guardian authorization. If you believe a child has provided personal information to us, please contact us at privacy@newday-newme.com so we can investigate and take appropriate action, including deletion of such information.

15. Third-Party Services and Links

Our Services may contain links to third-party websites, plugins, integrations, or services that are not owned or controlled by Opportunity & Achievements LLC. We are not responsible for the privacy practices, content, or security of those third parties. We encourage you to review their privacy policies before providing any personal information.

16. Do Not Track Signals

Some browsers transmit “Do Not Track” (DNT) signals. There is currently no universally accepted standard for how companies should respond to DNT signals. At this time, we do not respond to DNT signals, but we will continue to monitor developments and update our practices as appropriate.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or business operations. When we do, we will revise the “Last Updated” date at the top of this page. If changes are material, we may provide additional notice through email, in-product notification, or a prominent website banner, where required by law.

Your continued use of the Services following the posting of updated terms constitutes your acceptance of those changes. We encourage you to review this Privacy Policy periodically.
